Website Terms of Use

These Terms of Use govern your access to and use of the website at oiva.com.au (the “Site”), operated by Oiva Developments Pty Ltd (ABN 93 693 621 457) (“Oiva”, “we”, “us” or “our”). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

1. About the Site and the Oiva platform

The Site provides information about the Oiva platform, which is currently in a pilot phase and not yet generally available. Nothing on the Site is an offer capable of acceptance to supply the platform. Access to the platform, when available, will be subject to a separate written agreement with pricing, service levels and data terms. Features, timelines and screenshots shown on the Site are indicative and may change.

2. Waitlist

If you join our waitlist, you agree that:

  1. (a) joining the waitlist does not guarantee access to the platform or any particular onboarding date;
  2. (b) we may contact you about the platform and related updates, and you may unsubscribe at any time; and
  3. (c) the personal information you provide is handled under our Privacy Policy.

3. Acceptable use

You must not:

  • use the Site for any unlawful purpose;
  • attempt to gain unauthorised access to the Site or related systems;
  • introduce malicious code;
  • scrape, harvest or bulk-extract content or data from the Site, including for the purpose of training machine-learning models, without our written consent;
  • interfere with the Site’s operation; or
  • misrepresent your identity or affiliation.

4. Intellectual property

The Site and its content (including the Oiva name, logos, text, graphics, page designs and software) are owned by or licensed to Oiva and protected by Australian and international intellectual property laws. You may view and print content for your personal or internal business evaluation purposes. You must not otherwise reproduce, modify, distribute or commercially exploit Site content without our written consent. “Oiva” and “The Oiva Pledge” are trade marks of Oiva Developments Pty Ltd.

5. Information only, not advice

Content on the Site, including material about the Child Care Subsidy, regulatory compliance or sector practice, is general information only. It is not legal, financial or professional advice, and it is not advice from any government agency. You should obtain your own advice and verify entitlements and obligations with the relevant authorities before acting.

6. Third-party links

The Site may link to third-party websites. We do not control and are not responsible for their content or privacy practices, and a link is not an endorsement.

7. Australian Consumer Law and liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other statutory right that cannot lawfully be excluded.

To the extent permitted by law:

  1. (a) the Site is provided “as is” and we do not warrant that it will be uninterrupted or error-free;
  2. (b) our liability for any claim arising out of or in connection with the Site is limited, at our election, to resupplying the relevant content or service or paying the cost of resupply; and
  3. (c) we are not liable for indirect or consequential loss.

Nothing in these terms limits liability that cannot be limited at law, including liability arising from our own fraud or wilful misconduct.

8. Privacy

Our collection and handling of personal information through the Site is described in our Privacy Policy and Cookie Policy, which form part of these terms.

9. Changes, suspension and termination

We may update these terms, and change, suspend or discontinue any part of the Site, at any time. Material changes will be indicated by updating the date above. Your continued use of the Site after changes take effect constitutes acceptance of the updated terms.

10. Governing law

These terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
